An Act to Amend the Motor Vehicle Act
His Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 Paragraph 7(2)(c.2) of the Motor Vehicle Act, chapter M-17 of the Revised Statutes, 1973, is repealed.
2 Paragraph 26(a) of the Act is repealed and the following is substituted:
(a) under the vehicle identification number and the vehicle registration plate number;
3 Section 27 of the Act is amended
(a) by repealing subsection (2) and substituting the following:
27( 2) The registration certificate shall be delivered to the owner on paper or in printable format.
(b) by adding after subsection (2) the following:
27( 2.1) The registration certificate shall indicate the date issued, the name and address of the owner, the vehicle identification number, the vehicle registration plate number and a description of the vehicle as determined by the Registrar, and also the registration certificate shall contain a form for notice to the Registrar on transfer of the vehicle.
27( 2.2) An owner who receives a registration certificate in printable format is required to print it for the purposes of this Act.
(c) in subsection (3)
( i) in the portion preceding paragraph a) of the French version by striking out “délivré” and substituting “remis”;
( ii) in paragraph (a) by striking out “on the face of the certificate”;
( iii) in paragraph (b) by striking out “on the face of the certificate”.
4 Section 27.1 of the Act is amended by striking out “Notwithstanding subsection 27(2),” and substituting “Despite subsection 27(2.1),”.
5 Section 28 of the Act is amended
(a) in subsection (1)
( i) in the portion preceding paragraph a) of the French version by striking out “Nul ne doit” and substituting “Il est interdit à quiconque de”;
( ii) in paragraph (b) by striking out “photostatic copy” and substituting “copy”;
(b) in paragraph (2)(a) by striking out “photostatic copy” and substituting “copy”.
6 Section 29 of the Act is amended
(a) by adding after subsection (1) the following:
29( 1.1) Subsection (1) does not apply to the renewal of a vehicle registration.
(b) by repealing subsection (2);
(c) by repealing subsection (3) and substituting the following:
29( 3) A registration plate and the required letters and numerals on it shall be of sufficient size to be plainly readable from a distance of 30 m during daylight.
7 The heading “Sticker” preceding section 31 of the Act is repealed and the following is substituted:
Evidence of renewal of registration
8 Section 31 of the Act is repealed and the following is substituted:
31 On the demand of a peace officer, an owner or driver of a vehicle shall produce evidence of the renewal of the vehicle’s registration.
9 Section 37 of the Act is amended by striking out “a duplicate or substitute or a new registration under a new registration number” and substituting “a duplicate, a substitute or a new registration”.
10 Section 40 of the Act is amended by striking out “endorse” and “the reverse side of the registration certificate” and substituting “record” and “the registration certificate”, respectively.
11 Paragraph 68(b) of the Act is amended by striking out “and affixed to the vehicle in the manner ordered by the Minister the sticker issued for the vehicle by the Registrar for the current registration year”.
12 Subsection 103(3) of the Act is amended by striking out “the registration number of the motor vehicle so rented,” and substituting “the vehicle identification number and the vehicle registration plate number of the motor vehicle that is being rented,”.
13 Section 127 of the Act is amended by striking out “name, address, and the registration number of the vehicle” and substituting “name, address and the vehicle identification number and the vehicle registration plate number of the vehicle”;
14 Section 129 of the Act is amended by striking out “name and address and of the registration number of the vehicle” and substituting “name and address and of the vehicle identification number and the vehicle registration plate number of the vehicle”.
15 Section 136 of the Act is amended by striking out “the serial number, registration number, and the name and address” and substituting “the vehicle registration plate number and the name and address”.
16 Subsection 260(7) of the Act is amended by striking out “where the vehicle referred to in the certificate bears the same registration number as the vehicle in respect of which the offence is alleged to have been committed” and substituting “if the vehicle referred to in the certificate bears the same vehicle identification number and the same vehicle registration plate number as the vehicle in respect of the which the offence is alleged to have been committed”.
17 Subsection 265(2) of the Act is amended by striking out “the registration number of the vehicle involved,” and substituting “the vehicle identification number of the vehicle involved and the vehicle registration plate number of the vehicle involved,”.
18 This Act or any provision of it comes into force on a day or days to be fixed by proclamation.
